I would suggest taking an "infopass" and checking on the status of your case.

I think those bills will only be related to toughening border security n patrol..

Most likely...

But if we have a coordinated campaign to target the senators with letters/web faxes...who know we might be able to get some interim relief as part of the border security bills.

We should atleast try to recapture the visa's lost since 2000.

I for one am sending letters to both my senators. I read in one of the posts that sending letters via snail mail is ideal, along with basic info about your I140.

There is an excellent template of such letter in one of the media campaign thread.

According to the revised law, a law officer cannot approach any legal immigrant and ask for documents unless he is already questioning that person for some other offence

Hence I dont think u need to take the docs to an Ice cream shop, but a copy in the car or something wud suffice logically !!

Has anyone considered: In Arizona, what's going to happen to all of the immigrants who are there perfectly legally and are actually creating American jobs via the EB5 green card program? Will the be harassed? I say probably.

C# is a .NET language! C++, though, can either be .NET (managed) or unmanaged. You should clarify that with whatever job you are hoping to work on :)

The thing about .NET is that its main language is MSIL (Microsoft Intermediate Language). All of the .NET languages such as C#, VB, C++, etc. get squashed into MSIL.


I am utterly confused here. I see different jobs and stuff for .NET or c# or c++, etc. I thought they were all a part of .NET? Why for example, are the forums c# separated from c++, when they are both part of the same framework? I seriously can not wrap my head around this. If somebody says "I need some .NET work", are they referring to any language within .NET, like c# and c++? Please help me!

i am in same situation. i applied for employment base in Dec 2004 and family based in May 2006 through my sister. Rightnow i'm on EAD and my sister based F4 category have priority Dec 2001.


You can apply in both category. when i was filing 485 (EB3), there is question if any other 485 petition is pending? The answer is "NO" even i have applied (I-130) under Family based GC. My lawyer said filing I-130 (for family based GC) is not consider as another petition (485) for GC. So it is ok to apply in both.

Well, the first thing that I noticed was not the ceiling, but rather the cute little Shetland Sheepdog in the middle of the walkway. Of course, I love dogs (and especially Shelties)... ;)

I think if I stare at the image long enough, I can sometimes see the effect you're talking about, though it's not like that effect jumps out at me. IMHO, this picture is still a good study of geometric forms, whether or not it has issues with optical illusions. :)

If the exec is laid off, the dependent cannot continue working.
All beneficiaries of the petition must leave the US immediately.
I don't think there is any regulation that the employer needs to pay for relocation, but usually, they will provide you a one-way ticket back to your homecountry, but that will be the least of your worries.

Avoid working on L2 if you think the L1 sponsoring company is not trust-worthy or stable.


An L-1 work visa is issued to an executive of a company that has worked with his/her company outside of the USA for at least one year. Dependents receive L-2 visas and a spouse can apply for an EAD. Trouble is, if the exec is laid off, all of the dependant visas immediately expire and both the exec and his/her spouse must leave the USA!

Any ideas how to alleviate this issue? Getting a H1B visa is impractical since they are so scarce.

Also in this case, is the exec's employer liable for relocation expenses?

As it sound to me It means PD of primary applicant will be the PD of spouse and child.

I did not follow.

Anyway this is the situation. I'm in EB3 with a PD Dec 2002. DH is in EB2 with a PD in 2006. Can he file I-485 for us using my PD according to the above law?

To all IV members and the core team:

Thanks a bunch for mobilizing members to get their voices heard - first at the historic San Jose rally of high-skilled legal immigrants, and now with this monumental effort in DC on September 18th.

Thanks to all your efforts (myself included), we were able to file for Adjustment of Status (AOS), EAD and AP in July, and had the extension till August 17th to file it for those of us who couldn't do it sooner.

Thanks also to the lawmaker(s), and others who voiced their opinions and drew attention to the plight of highly educated, skilled, tax-paying, brilliant, and entrepreneurial folks, waiting for their GCs for as long as a decade.

We finally received our EADs yesterday, and our APs have been approved (awaiting notices).

The road from here to finally becoming permanent residents and perhaps eventually citizens of this great country (for those of us who wish to) is a long, winding one, full of tricky situations, significant risks, and the inevitable delays by the agencies concerned.

We all need to collectively make our voices heard, tell the lawmakers, the media, and the world about our lives that we continue living in limbo, and will be forced to do so for a long long time if we don't act.

I WILL ENTHUSIASTICALLY JOIN THE DC RALLY NEXT WEEK.

How do you know that your case has been transferred from NSC to TSC.

Receipt has address of issuing office at the bottom of it. I also had nothing showing up in the system until yesterday, but today, our EAD's are in the system, but not I-485 or I-131. Perhaps EAD is considered a priority.

My company would like to send me France on business.
But My H1 visa expired Jan 2006.
I got H1 approval up 2009 but passport is not stamped.

My lawyer told me that I can go to Paris (France) and visa stamped.
I am not sure France consulate will issue me visa to enter France.

Any comments and any input?

1. I need advice as to how to withdraw the I-485 AOS application. I do no have copy of documents/notices that USCIS sent.They are with my wife.
Or
2. If we do work out our differences then is there a way to keep the current AOS alive? Or shall I get the current one withdrawn and file for a new one if we do resolves our differences?
3. Also if I do withdraw the I-485 does it also mean that the I-130 filed by my wife is abandoned/revoked automoatically?

Sorry about your marriage problems. If there is a chance that you might be able to work things out, I suggest rescheduling the 485 interview. If you even have the interview letter, then you should have the receipt number and your A# that can be used to track the file. You can also use these to withdraw the 485 if you need to.

If you do withdraw the 485, it would not automatically revoke the I-130, assuming this is approved. It may not be approved, however.

Hi, I am actually in a similar boat as you. Though I have an April 2006 PD for EB3 and am now on EAD as well.

Question1: Is it better to try and port my EB3 to EB2 with a different employer. Isn't GC for future employment ? If so, can't I negotiate with another employer and file new labour under EB2 and try and port my priority date from EB3 ? Also, if I do this will my current employer find out ?

Questions2: What is the process for porting EB3 to EB2 without current employer finding out ? What documents are required ? My current employer is not going to give me a copy of my I-140 or my Labour Cert. All I have is the receipt notice of my I-485 filing and my AP/EAD documents.

Questions3: Is it possible that since there are so many India EB2 applicants and fewer India EB3 applicants that it is better to stick with EB3 April 2006 PD ? Dosen't a seperate quota get allocated to EB3 than that which gets allocated to EB2 each year or will EB3 always be behind EB2? Please advise.

I will really appreciate someone who has experience with these issues to advise me on them.

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.

So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.

IS that a possibility ? any inputs ?

Guys,

Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?

She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.

We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.

My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?

A lot of you may have experienced the same dilemma, so please let me know...

We are a canadian family who moved to the US about 10 years ago. We are US permanent residents; all have green cards. My husband lost his job in the US last month and we are currently staying with family in Canada until my husband gets another job. But this other job may be in Canada or in the US again. Until he gets an answer and we relocate, we would like to put our children in school so they don't fall behind by the time we get to our next destination - which could be about another month or so. If we place our children in canadian schools until then, will this jeopordize our green card or status?

Does anybody have idea or experience how long it takes for USCIS to make desicion about I-485 expedition (pending for 2.8 years now)?
My hospital sent expedition request to TSC about 3 months ago, there is no replay yet.
I'll appreciate any advice/information.

When I click on my case on the online case status website (of USCIS) still provides old data only and does not reflect the status for LUD...

Hello,

I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?

Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.

Let me give my case background in details.

* LC applied in oct'07
* I-140 applied in May'08 after LC approval
* 6th yr on H1 ended in June 08
* had to return India since my LC < 1 yr and I-140 was not approved
* Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
� Mar09- applied 7th yr extension based on Approved LC (> 1 yr old ) and applied I-140
� Apr09- I-140 approved
� May09 � Received RFE on H1 extension, replied along with a copy of Approved I-140 hoping to get 3 yrs extension
� Jul09 � Received approval on H1X extension for 1 year with petition valid till Jun'09 (1 yr extension)

Appreciate your advise on the same.

I have a request / concern / what ever you would say.

Please do not cirtize if you do not like the idea, just ignore and leave the thread.

There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....

Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.

You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.

These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.

Gurus, please provide your thoughts.

Please do not ignore this though. It might become a very good guidelines/guide/rulesbook for all, not all questions might be answered but we can atleast try to cover most of the questions through survery and then create the thread for each topic.

Good luck to all. IV is great in doing such a tremendous job.

My Scenario

-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.

-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.

Here are my questions -

1. Can i apply for change of status now or do i need to go back to India?

2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?

3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

Thanx a lot. I have been searching for a non profit job for the last 4 months with no result. That is why I am trying to find other options. I also researched the GC, but I am not sure if u can work with the Labor Cert only or need another visa.

your wife's application should be tied to your PD. If you got it in EB1, then she too should be in EB1. The pearson memo will help. Get an infopass and clarify the issue.

You need to be in valid H1B status to get H1B extension. If you have abandoned it or it has expired, then you are subject to H1B quota. But I don't have any document/memo to support it. Wait for more senior people's response.
