If you were subject to the cap for the last H-1B, you will not be subject again. The new employer would need to file a change of status for you, changing you from B-2 back to H-1B.

I have e-filed my EAD & AP Renewal last week and trying to send supporting documents and I can't find what needs to be sent for this.....
Questions:
1) Do we need to send any photographs for my AP?
2) Any proof of Identification (passport first page) or Drivers License
3) Any H1 approval notices? (I am still on H1B)
4) Also I filed my AP which is expiring in Dec-08 i.e. 150 days before its expiry and curious to know if anyone�s application got rejected or approved. (I guess 120 days is the limit)
I appreciate your time and response.

From what I have heard from close friends/relatives, your option B is correct.
Also, people living abroad and coming here and getting citizenship is only possible as you know if they fulfill the physical presence and continuous residency requirements. Further, since they have a US address (and can provide proof for it), why should the 90 days USCIS district requirement be an issue?!

I was following a tutorial that was for photoshop 7 and all was going well untill it said to drag the "grid channel" onto the "load channel as a section"...!!!
But any way I tried it your way and it worked fine so thanks a lot I've been trying to figure it out all day.:bandit:

At the time of filing my application I just used one address.
Somehow I didn't know you could use Permanent address and current address.
I'm not sure but I guess my lawyer didn't file G325 form.
Is filing G325 form something mandatory ?
I've moved recently.
I want to change the address now but want to give a new address (which is not the address I moved to .)
Should it be fine?

pnagar: (1) Employment Verification Letter with your Job roles, responsibilties, which should match/similar to your GC labor; and your annual income. (2) Once your 140 is approved and 180 days have passed after filing 485; it will not affect you even if your employer withdraws the 140 application. I'm in H1B visa and my visa was valid until 26th October , 2012. Recently, I went Bangladesh and US embassy stamped visa until October 23, 2011. When I returned US, Immigration office issued me I-94 validity until September 23, 2011. Now how long I can stay in US?? Do I need to apply for H1B visa extension or I will go to Canada or Mexico to apply for new visa or if I go to Canada or Mexico and return back, they will issue me a new I-94 until Sep/Oct 2012. Any one please suggest what should I do?
Your stay is legal until your I-94 specified date. You can get it resolved by INS or go out of US and reenter (which may turn out to be faster). And this time while entering make sure Immigration officer puts right date on your I-94.

Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.

I didnt mean to burst your bubble...but may be its just that you are getting another finger printing notice. Its expires in 15 months. If you read the other forums July 07 filers have started getting their next set of FP notices. I wouldnt get too carried away.

I have a big problem that I got approved on the H1 Recapture to get back into US on January 15, 09 though my attorney screwed up by putting someone else background into the Petition Letter submitted to USCIS with my application. The petition letter to USCIS is all wrong. It states the wrong education, work experience and job duty. They put somebody else background into mine. They put the correct sponsoring company on the first page of the letter though at the end of the second page they put the wrong sponsoring company. In this case, what should I do and what should I answer at the US Consular in Malaysia to get my H1 Visa? What should I do now? Please advise. Do I have to resubmit the application back to USCIS? Will I get rejected? Please help. Thank you very much.

Remember in a marriage case....it is a 2 step process...Initially they get a temporary Gc and then after 2 years they get a permanent GC. So, she needs to see which GC is she getting before making any decisions.

I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.
