    I changed jobs twice after I-140 approval/180 - days of filing 485. I am in the 6th year of my H-1B. Both the times I transfered my H-1B and got validity for 3 years based on AC-21.

    Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.

    My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?

    USCIS instruction say that if they can sign, they can sign the forms. Otherwise, you can sign and include signed by father or mother in front of the signature.

    I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. Also can anyone recommend a good lawyer. How much should it cost for me and my family(wife and 3 children ). Email me if you wish AT

    Hi,

    I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :

    Resident of India/Bhutan
    OR
    Indian Citizen residing in United States.


    I would really appreciate any help in this matter.

    I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
    Btw, am not sure of the reason for RFE yet.

    Has anyone had their 485 approved with an RFE pending on EAD or AP?

    1. If my father applies for GC for me under F2B can it be converted to F1 when he becomes citizen?

    YES

    if so, will the priority date be same or it will be new once converted to F1 category.

    IT WILL STAY THE SAME.

    2. Can I apply for both family based and employment based in parallel?

    YES, THIS IS COMMON.

    if it is not possible which path should I select? Will the employment based GC will be faster of family based?

    FAMILY-BASED AS THE UNMARRIED CHILD OF A US CITIZEN IS PROBABLY FASTER, ASSUMING YOU ARE FROM INDIA.
