Hi,
i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

Can someone work in US on H1B and in India for an Inidan company and get paid in Inidan currency? If H1B restricts you from doing so I am willing to switch to EAD if that permits me from working remotely for indian company.
that's how infy, wipro, tcs work...they get ppl here on H1 and get paid in dollars....once they go back to india, they get paid in rupees....u need h1 if ur in the US.

The United States Citizenship and Immigration Service (USCIS) has recently issued a fact sheet (http://www.aila.org/content/fileviewer.aspx?docid=30372&linkid=210853) reminding qualifying applilcants to apply EARLY for an Advance Parole document, as Advance Parole processing times take about 90 days.
The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization
If you are an Appllicant with a pending Application for Adjustment of Status to Lawful Permanent Resident (LPR) and need assistance with filing Form I-131 (http://www.uscis.gov/USCIS/New%20Structure/2nd%20Level%20(Left%20Nav%20Parents)/Forms%20-%202nd%20Level/Forms%20Static%20Files/I-131.pdf), contact our office, as we currently have a SPECIAL running for the preparation and filing of the Advance Parole (http://www.h1bvisalawyerblog.com/2009/10/special_ead_and_advance_parole.html) document.

I received a RFE asking for evidence that could prove that currently I am on a non-immigrant status. I abandoned my F-1 status after I filled my I-485, and from what I knew you were supposed to have the corresponding status before you filled the I-485 but there was no need to still have it after you got the AOS.
My question is if there is a possibility that what the officer is asking for is evidence that proves that I HAD the F-1 status before filling the I-485 and if I abandoned it after filling it.

Hi,
There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,
I have not found much info on this topic and so, decided to post this question.Thanks in advance for your replies.

My employer has job posting Bachelor's degree with 7 years of experience but does not say anything about Masters Degree. Wanted to know this job requirement fall under EB2 or EB3?. appreciate for the response.
The advt is very sensitive. My friend lost his eb2 chance because of that.

Did you got it screended with your/company attorney about the advt description

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

This is getting ridiculous...losing my patience
I think a controlled slow movement is good at the beginning of the year. Last year they had made, for example, EB2 India as April 2004 but they had to make it U after 1st quarter.
So, a controlled slow movement will leave to more un-used numbers in the 3rd quarter when they will then be forced to make big jumps in dates to use up annual visa numbers

I am sorry to ask...If H1B doesn't have I-94 attatched to it and it was approved when my friend was in india, he can work on L1. My question is, if he moves out of country and get H1B stamped, can he work on L1?

I was working with employer -A till 2006 and got I140 approved (Feb 2006) in EB3. In November 2006 I joined employer B as it is good for my carrier. I talk to employer A (body shopper) and he is ready to support for my green card as I worked for him for six long years and still he did not cancel my old H1B.
1. I have two options here my old employer (A) is body-shopper. So he will agree for both future or current employment. I have very good permanent job and bright future prospects with new employer (B). In this case what you guys advice me? Apply I485 as future employment or quit present job and join old employer (A) and apply I485 as current employment?
2. If I do not join old employer (with whom I have I140 approved) now, in this case what are my options for I485 applying? (Only future employment I485/ I can file current employment I485 and not drawing any salary from old employer )
3. Will I485 as future employment has any problems?
4. Can I use AC21 after 180 days on my I485 future employment application?
Appreciate your advice in this matter. Thanks in advance to all your replies and wish you best of luck.
