I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.
You will need to have the petitioner file an amended petition only if there has been a material change in the terms and conditions of your employment.
Compare the job duties (not just job titles) of the original and new job to determine if they are in the same Standard Occupational Classification (SOC). See, Find Occupations (http://online.onetcenter.org/find/). If the jobs are in the same SOC, they would both have the same prevailing wage and no material change has occurred. In that case, you may only need to get a new LCA. All LCAs take up to 7 business days to get certified by the DOL. I am on H1 and 3 months back i came to US.After one month i applied for SSN,but still didnt get that.
when i went to SS office for enquiry 1 week back, they told me that my immigration verification was not done yet. so i had to wait.

My EAD card was returned as undeliverable as Mail Box didn't have my name on it.
I changed my address and requested the Card to be resent. CSR said it would take 3-5 business days.
I spoke with a IIO today and she said it would take 4- 5 months to get remailed as per their policy.
Which one is right ,CSR/IIO?
Is there anything that I could do to get my card earlier?

I am on my 9th year extension of my H1B. I have to leave to my home country at a short notice. I have H1B stamped on my passport. However it expires at the end of September. I may not be back until the first week of September.
I have already filed for my H1B extension and I am waiting for my Receipt notice.
Will there be any issue coming back into US when my visa stamped on my passport is valid for less than a month. I don't think my extension will be processed by then.
Anyone on this forum who has had similar experience in the past?

I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India
Can she travel on H4 stamping or she need to get AP

the only difeerence is in the ease with which you shift employers.
when it was not called transfer you had to wait for approval of new H1 but now you can start working for new employer upon getting the receipt.

I am not sure if this works or not, but try to create a yahoo group id and add these email addresses as the members of the group.
Then you can just shoot your e-mail to this group address.

I need some serious advice, saw a few related threads, hence joined this forum immediately to get some help...
My 6 years H1 B limit ends in August 2008.Stamp on I-94 is also as of Aug 08
Question 1) Employer A filed for I-140 in October 2007. Due to some serious medical conditions I was unable to work from Nov '07 till date. My employer terminated my employment in March 2007 as I was not working then and not in a state to work either.
I dont think Employer A has revoked my H1B coz I got my I-140 approved thru Employer A, this June (2008). Am I out of status per USCIS/INS 'on paper' ?
Question 2) I am now capable to resume work. In June 2008 I have found Employer B. What are my chances of getting my H1B successfully transferred to Emp B. The last pay stub is as of Oct 2007. I can get a medical certificate explaining my absence from work till date.
Question 3) Also, with Employer A's approved I-140, can I apply for a 3 year extension for Employer B since my 6 year tenure ends next month - Aug 08 ?
Question 4) How will the entire process work. What r my chances ? If the H1 gets approved do I have to leave the country and re-stamp ? If the H1 gets approved why shud I leave the country, can I not just start work coz I have another 3 year extension becoz of the approved I-140 thru Employer A ?

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

You can go to any industry financial, insurance, pharma etc but your job and duties should be similar to your current one. If your current position is *mathematician* and your new job says "consultant" it will catch the officer's attension easily. But from other threads in understood that your job description should be similar to your current ones. Please go thru some IV threads.
